We are CREAiT LLC, doing business as CREAiT ("Company," "we," "us," "our"). We operate the website https://getcreait.com (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

CREAiT provides an AI-powered business operating system designed to help service-based small business owners automate their operations, manage customer relationships, and scale their businesses efficiently. Our platform includes customer relationship management (CRM), marketing automation, lead capture, appointment scheduling, and business intelligence tools.

These Legal Terms constitute a legally binding agreement between you and CREAiT LLC. By accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution would be contrary to law. The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.), so if your interactions are subject to such laws, you may not use the Services.

4. User Registration

You may be required to register to use the Services. You agree to keep your password confidential and are responsible for all use of your account. We reserve the right to remove or reclaim usernames we determine to be inappropriate or objectionable.

5. Purchases and Payment

We accept Visa, Mastercard, American Express, and Discover. You agree to provide current, complete, and accurate purchase and account information for all purchases. All payments shall be in US dollars. We may change prices at any time. We reserve the right to refuse any order placed through the Services.

6. Free Trial

We may offer a free trial to new users who register with the Services. The account will be charged according to the user's chosen subscription at the end of the free trial period unless cancelled before the trial ends.

7. Subscription and Cancellation

All purchases are non-refundable unless otherwise required by applicable law. You can cancel your subscription at any time by contacting us at [email protected] or through your account settings. Your cancellation will take effect at the end of the current paid term.

8. SMS / Text Messaging Terms

By providing your mobile phone number and opting in to receive SMS messages from CREAiT LLC, you agree to the following terms:

8.1 SMS Use Cases

CREAiT LLC uses SMS/text messaging for the following purposes:

• Transactional messages: appointment reminders, booking confirmations, account alerts, and service updates.

• Customer support: responses to inquiries submitted via our platform.

• Promotional messages: special offers, product announcements, and event notifications (sent only to users who have explicitly opted in for marketing communications).

• Operational alerts: system notifications and important account information.

8.2 Opt-In Consent

By submitting your mobile phone number through any of our web forms, checkout pages, or other opt-in mechanisms and checking the consent box, you expressly consent to receive SMS messages from CREAiT LLC at the number provided. Consent is not a condition of purchase.

8.3 Opt-Out Instructions

You may opt out of receiving SMS messages from CREAiT LLC at any time by:

• Replying STOP to any SMS message you receive from us.

• Contacting us directly at [email protected] and requesting removal from our SMS list.

After sending STOP, you will receive a one-time confirmation message confirming you have been unsubscribed. No further SMS messages will be sent to your number unless you re-opt-in. If you need help, reply HELP or contact [email protected].

8.4 Message Frequency

Message frequency varies based on your account activity, subscription type, and preferences. You may receive recurring messages. Message frequency will not exceed what is reasonably necessary for the purposes described in Section 8.1.

8.5 Message and Data Rate Disclosure

Message and data rates may apply to all SMS messages sent to or from CREAiT LLC. These charges are assessed by your mobile carrier and are not charged by CREAiT LLC. Check with your mobile carrier for applicable rates, plan details, and data usage charges. CREAiT LLC is not responsible for any charges incurred from your mobile carrier.

8.6 Carrier Liability Disclaimer

CREAiT LLC is not liable for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission from your network operator. Message and data rates may apply. CREAiT LLC does not guarantee the delivery of SMS messages. Network availability and handset compatibility may affect message receipt.

8.7 Supported Carriers

Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, and other major U.S. carriers. Carrier support may vary and CREAiT LLC does not warrant that its SMS services will be available through all carriers.

9. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. Prohibited activities include, but are not limited to:

• Systematically retrieving data to create a collection, compilation, or database without written permission.

• Tricking, defrauding, or misleading us or other users.

• Circumventing, disabling, or interfering with security-related features of the Services.

• Using the Services in a manner inconsistent with any applicable laws or regulations.

• Uploading or transmitting viruses, Trojan horses, or other harmful material.

• Engaging in any automated use of the system, such as data mining or scraping.

• Using the Services to send unsolicited communications, promotions, advertisements, or spam.

• Attempting to impersonate another user or person.

10. User Generated Contributions

The Services may invite you to create, submit, post, display, or transmit content, including text, writings, video, audio, photographs, and other material (collectively, "Contributions"). Contributions may be viewable by other users and through third-party websites. Any Contributions you transmit may be treated as non-confidential and non-proprietary.

11. Contribution License

By posting your Contributions to the Services, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide right and license to use, copy, reproduce, disclose, publish, broadcast, translate, and distribute such Contributions for any purpose. You retain full ownership of all of your Contributions and any associated intellectual property rights.

The Services may contain links to other websites or content belonging to or originating from third parties. We are not responsible for any Third-Party Websites or Third-Party Content. If you access third-party websites or content, you do so at your own risk.

13. Privacy Policy

14. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Services to any person for any reason, including breach of these Legal Terms. If we terminate or suspend your account, you are prohibited from registering a new account.

15. Governing Law

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.

16. Dispute Resolution

The Parties agree to first attempt to resolve any Dispute informally for at least thirty (30) days before initiating arbitration. If informal negotiation fails, the Dispute will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA), taking place in Atlanta, Georgia. The Parties agree that any arbitration shall be limited to individual disputes and shall not be conducted on a class-action basis.

17. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT.

18. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. OUR LIABILITY WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

19. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand arising out of: (1) your Contributions; (2) use of the Services; (3) breach of these Legal Terms; (4) your violation of the rights of a third party; or (5) any harmful act toward any other user of the Services.

20. Age Restriction

The Services are intended for users who are at least 18 years of age. By registering for or using the Services, you represent and warrant that you are 18 years of age or older. We do not knowingly collect information from or market to individuals under 18. If we learn that a user is under 18, we will promptly close their account.

21. Miscellaneous

These Legal Terms constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver. If any provision is determined to be unlawful, void, or unenforceable, it is severable from these Legal Terms and does not affect the remaining provisions.
